We as operators of the website at www.rooftech.de (also "Website") are responsible within the meaning of the applicable data protection law, in particular the General Data Protection Regulation (“GDPR”), for the personal data of the user (“you“) of this website.

In the following, we will provide you with clear information within the scope of our information obligations (Art. 13 ff. GDPR) about which data is processed when you visit our website and on what legal basis this happens. You will also receive information about which rights you have vis-à-vis us and the responsible supervisory authority.

2. Informational use of our website

When you access our website just to visit it, so-called logfiles processed by our system automated The following log files are processed automatically:

  • IP address of enquiring computer
  • type of Internet browser used
  • language of the Internet browser used
  • version of the Internet browser used
  • operating system and its version
  • operating system interface
  • Called pages
  • Date and time of visit
  • Time Zone Difference to Greenwich Mean Time (GMT)
  • access status/http status code
  • Amount of data transferred
  • success or failure of the loading process
  • Referrer
  • Websites accessed by the visitor's system via our website
  • Internet service provider of the user

The log files contain your IP address and possibly other personal data. Therefore, it is generally possible to assign them to you. However, we only store your data temporarily and in particular not together with other personal data.

The processing of the above-mentioned data is necessary for the provision of our website. We also store the data for the purpose of ensuring the security of our information technology systems. These purposes also justify our legitimate interest in storing the data on the Legal basis Art. 6 (1) lit. f GDPR. The log files, which also contain your IP address, are deleted or anonymized immediately after they are no longer required to achieve the aforementioned purposes, but usually after 90 days at the latest.

3. Contact us by email, telephone or fax

 You have the option to contact us by email, telephone or fax to contact you. Your personal data transmitted in this way will be stored by us. The data will only be processed to process your contact request. The Legal basis for the processing of your personal data is Art. 6 (1) lit. f GDPR. The data will be stored until it is no longer required to achieve the purpose of the conversation with you and the purpose of your contact has been fully clarified.

If your contact is aimed at concluding a contract with us, the additional Legal basis for the processing of your personal data Art. 6 (1) lit. b GDPR. This data will be stored for as long as it is necessary to carry out the contract or the pre-contractual measures. In addition, we only store your data in order to comply with contractual or legal obligations (e.g. tax obligations) (Art. 6 (1) lit. c GDPR).

In addition to the data that you voluntarily provide to us, we may receive the time (date and time) when your data was transmitted to us, as well as your IP address. The processing of this data corresponds to our legitimate interest (Art. 6 (1) lit. f GDPR) in order to ensure the security of our systems and to prevent misuse. This data, which we additionally collect when you contact us, is deleted as soon as it is no longer required, at the latest when the matter of your contact has been fully clarified.

You can inform us at any time (see section 1 above) that we should delete the data communicated during the conversation. In this case, all personal data from the conversation will be deleted, as far as permissible, and it will not be possible to continue the conversation. 

4. Cookies

Please note the following: You can ensure that no cookies are stored on your computer at all, or that only certain cookies are allowed to be stored. You can select this in your Internet browser settings. You can also view and delete the stored cookies there.

If you block all cookies, not all functions of our website may be available to you.

We may use cookies on our website. Cookies are text files that are sent from our web server to your browser when you visit our website and are stored on your computer for later retrieval. A cookie can therefore be used to identify your Internet browser when you visit the website again. There are session cookies, which are deleted when you close the browser, and there are persistent cookies, which are stored on the hard drive until their preset expiry date is reached or until you actively remove them.

Opposition and removal possibility

5. WP Statistics

We integrate the WP Statistics tool locally (on the server that hosts our website). This is an analysis tool that shows us statistics about visitors and visits to our website. The IP addresses are anonymized and hashed at the beginning of the session. It is therefore not possible for us to identify you as a visitor to our website using the tool. Using the tool's statistics, we can determine, for example, which countries our website is accessed from, which referrer sites, which browser is used, which platform is used, and which search terms or search engines we were found with. We can use this information to understand the use of our website and optimize our services.

6. YouTube

For the purpose of making our website attractive, we integrate videos from YouTube of Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA (hereinafter: "YouTube“). We use the extended data protection mode so that information about you is only shared with YouTube if you activate the video by clicking the play button of the video.

If you activate the video, YouTube uses cookies to collect information for analysis purposes and to improve user-friendliness. According to YouTube, the data is processed pseudonymously. However, if you are logged into your Google or YouTube account, the data may be linked directly to your YouTube account.

Legal basis for the integration of the YouTube service on our website and the associated processing of your data is Art. 6 (1) lit. f GDPR. 

7. Use of service providers 

We would like to point out that we may use service providers with whom we have concluded data processing agreements to process your personal data (e.g. for website hosting). If data processors in a third country (not within the EU) carry out data processing, we ensure that the level of protection of your data guaranteed by the GDPR is not undermined (Art. 44 ff GDPR).   

8. Your rights

If we process your data, you are a “data subject” within the meaning of the GDPR. You have the following rights: right to information, right to Right to rectification, right to Restriction processing, right to Erasure, right to briefing and right to Data portability. In addition, you have a Right of objection , and a Right to cancel
 and the right to Supervisory authority to complain.

Below you will find some details about each right:

a. Right to information

You have the right to request confirmation from us as to whether we process your personal data. If we process your personal data, you have the right to receive information about the purposes of processing, categories of personal data, recipients or categories of recipients, and, if applicable, the storage period.

b. Right to rectification

You have the right to have the data we have stored about you corrected and/or completed if this data is incorrect or incomplete. We will carry out the correction or completion immediately. 

c. Right to restriction of processing

Under certain circumstances, you have the right to request that we restrict the processing of your personal data. An example of this is if you dispute the accuracy of your personal data and we need to verify the accuracy for a certain period of time. For the duration of the verification, your data will only be processed to a limited extent. Another example of a restriction is if we no longer need your data, but you need it for a legal dispute.

d. Right of deletion

You have the right to request that we erase your personal data without undue delay in certain situations. This is, for example, the case if we no longer need your personal data for the purposes for which we collected the data, or if we have processed your data unlawfully. Another example would be if we process your data based on your consent, you withdraw your consent and we do not process the data based on another legal basis. However, your right to erasure does not always apply. For example, we may process your personal data to comply with a legal obligation or because we need it for legal proceedings.  

e. Right to information

If you have asserted your right to rectification, erasure or restriction of processing vis-à-vis us, we are obliged to inform all recipients to whom we have disclosed your personal data of the rectification, erasure or restriction of processing of your data, unless doing so should prove impossible or involve disproportionate expenditure. 

f. Right to data portability

Under certain conditions, you have the right to receive the personal data you have provided to us in a structured, common and machine-readable format and the right to have this data transmitted to another controller. This is the case if we process the data either on the basis of your consent or on the basis of a contract with you and we process the data using automated procedures.

You have the right to request that we transmit your personal data directly to another controller, provided this is technically feasible and does not affect the freedoms and rights of other persons.

g. Right of objection

You have the right to object at any time to the processing of your personal data based on Art. 6 (1) lit. e or lit. f GDPR, for reasons related to your particular situation. This also applies to profiling referred to in these provisions.

After an objection, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims. 

If we process your personal data to Direct mail to operate, you have the right to object at any time to the processing of your personal data for the purpose of such advertising. This also applies to profiling insofar as it is related to direct marketing. If you object to the processing of your personal data for direct marketing purposes, we will no longer process it for these purposes. 

h. Right of withdrawal

According to Art. 7 (3) GDPR, you have the right to withdraw your consent at any time. Withdrawing your consent does not retroactively invalidate the legality of the processing. 

i. Right to lodge a complaint with a supervisory authority

You have the right to lodge a complaint with a supervisory authority, without prejudice to any other administrative or judicial remedy. In particular, you can exercise your right to lodge a complaint in the Member State of your residence, place of work or place of the alleged infringement if you consider that the processing of your personal data infringes the GDPR.
